What is personal bankruptcy?

Personal bankruptcy is a procedure that allows over-indebted individuals to repay their creditors from their assets within the limits of their abilities. During bankruptcy proceedings, they may also propose to the court that they be released from paying debts that were not settled from the existing assets in personal bankruptcy.

Conditions for personal bankruptcy:
A debtor is eligible if they are more than two months late with payments of their obligations or if their debts exceed the value of their assets.

Until the end of 2013, the court required an advance payment of EUR 2,200.
Following a change in legislation, this advance payment is no longer required.

Conditions for discharge of debts:

  • In case of unemployment, the debtor must actively seek employment

  • The debtor must not have had debts discharged in the past 10 years or disposed of assets free of charge in the past 3 years

  • The debtor must not incur new debts

  • The debtor must not have a final criminal conviction for an offense against property or the economy that has not yet been expunged

Other important information:

  • Personal bankruptcy proceedings typically last 2–5 years

  • All seizures and enforcement actions are suspended once personal bankruptcy is declared

  • A bankruptcy trustee manages your assets and leaves you a necessary subsistence portion

  • Your assets become part of the bankruptcy estate

  • You may be employed or unemployed

  • The income and assets of partners and family members are not part of the bankruptcy estate

  • You do not need to own assets to file for personal bankruptcy

  • A discharge of debts applies to all debts incurred before the start of personal bankruptcy
